How does the travel ban affect Venezuelans?

This week, the U.S. Supreme Court temporarily lifted the restrictions to President Donald Trump’s travel ban, allowing it to go into effect while the lower courts determine its merits. Whether or not the travel ban will go into permanent effect will depend on lower court opinions.

Many in and outside of the United States are wondering exactly how the travel ban impacts them and their loved ones, especially considering how many versions of the ban have come out this year. The version that the high court allowed to go into effect is the third one, originally released in September. It blocks the travel of most citizens from a list of countries to the United States.

One of the impacted countries is Venezuela. Government officials from Venezuela and their immediate family members are blocked from entering the U.S. Venezuelan nationals who are U.S. visa holders are subjected to additional screening. It does not impact Venezuelans’ ability to immigrate to the U.S.

The ban has no end date, but the federal government could consider revising any restrictions placed on countries if they meet certain minimum standards.

If you have family members in Venezuela who are government officials or the immediate family member of a government official, they will unfortunately not be allowed to visit you in the U.S. for now. However, that is the only restriction currently placed on Venezuelan nationals.

The Seattle-based Ninth Circuit Court of Appeals and the Virginia-based Fourth Circuit Court of Appeals are currently hearing arguments challenging the ban, which will likely decide whether or not this ban goes into permanent effect.
